Why Request Validation?
There are several compelling reasons to exercise your right to request validation of a debt before paying. Mastering the debt: Times have changed, and there has been a rise in illegitimate debt collectors who send invoices or make calls about fake debts, so don’t assume that an invoice from a debt collector automatically means you owe it. Confirming that you have not already paid the debt: If you have already paid the debt; you might vaguely remember owing the creditor named in the collection notice, or you may recall paying that debt at some point. To be sure, ask for proof. It’s your right. Forcing the debt collector to prove the debt is real: Sometimes, collectors revive old debts in an attempt to earn some money. In the case of old debts, there is a good chance that the collector does not have the original documents to prove you even owe it. Are you really going to pay someone who claims you owe them but cannot prove it? Of course not. Ensure the collector is licensed to collect the debt: Even if you truly owe the money, how do you know that the creditor actually hired this company to collect the debt on their behalf? What if you pay the collector, only to be faced with a claim from the creditor or another collector because the collector you paid was not originally appointed? A debt validation letter will help ensure you are paying the correct company for the right debt.
Debt Validation Requirements are Time-Sensitive
Within five days of first contacting you, a debt collection agency must send you a written notice of debt validation. This notice will include your right to dispute the validity of the debt within 30 days. The collection agency is allowed to include the debt validation notice in the first contact if that contact is in the form of a letter. When the first contact from the debt collection agency is made via phone, you must receive the debt validation notice from them within five days.
Submitting a Validation Request
For your request for proof to be legally valid, it must be in writing. A verbal request for validation over the phone is not sufficient to protect your rights under the Fair Debt Collection Practices Act (FDCPA). In your validation letter, you can dispute the entire debt, part of the debt, or request the name of the original creditor. Once the debt collection agency receives your validation request, they cannot contact you again until they provide you with the proof you requested.
