Former President Donald Trump’s aides, along with his Republican allies in Congress and even his rivals in the Republican primary, criticized the Colorado Supreme Court’s decision to bar him from appearing on the primary ballot for his party in the state, with some considering it a deliberate attack on the electoral process by the Democratic Party.
Key Facts
Trump’s eldest son, Donald Trump Jr., stated that the Democratic Party, which he described as the “Communist Party,” is “destroying democracy in the name of democracy,” while his younger son, Eric Trump, characterized the decision as “un-American and the typical scenario of the modern Democratic Party.”
Former White House Chief and Trump’s main advisor, Stephen Miller, claimed that Democrats had “declared war on democracy.”
Trump’s close aide and former personal attorney Rudy Giuliani described the decision as a “direct assault on democracy” and referred to the Colorado Supreme Court as “Democratic judges,” urging the U.S. Supreme Court to intervene and overturn the decision.
House Speaker Mike Johnson (R-LA) was among the Republicans in Congress who criticized the decision, stating that it is “nothing more than a blatant political attack” and a “reckless” decision he hopes the Supreme Court will overturn.
Representative Lauren Boebert (R-CO) criticized the Colorado Supreme Court, saying that the decision is “judicial extremism aimed at suppressing the ballot and the voices of hundreds of thousands of Coloradans.”
The decision also painted some of Trump’s close allies in Congress, such as Representative Matt Gaetz (R-FL) and Senator Rick Scott (R-FL), as an attempt by the Democratic Party to target Trump.
Surprising Fact
Trump’s rivals in the Republican primary also joined the chorus of Republicans criticizing the decision. In a post on X, Florida Governor Ron DeSantis wrote: “The left invokes ‘democracy’ to justify its use of power, even if it means abusing the judicial system to remove a candidate from the ballot on invalid legal grounds,” emphasizing the necessity for the Supreme Court to intervene and overturn the decision. Businessman and Republican primary candidate Vivek Ramaswamy criticized the decision in a video posted on X, calling it a “distortion” of the fourteenth amendment. Ramaswamy stated he would withdraw from the primary in Colorado until Trump’s name is restored to the ballot, writing, “I call on Ron DeSantis, Chris Christie, and Nikki Haley to do the same immediately – otherwise they are implicitly supporting this illegal move.” Nikki Haley and Chris Christie, who have criticized Trump more openly than other Republican candidates, were more reserved in their comments. At a campaign event in Iowa, Haley told reporters: “We don’t need judges making these decisions; we need voters making these decisions.” Christie expressed the same opinion while addressing a crowd in New Hampshire, stating that Trump should not be barred from being president by any court, but rather “should be prevented from being president of the United States by the voters of this country.”

Billionaire and X owner Elon Musk tweeted about the decision: “These actions will have the opposite effect of what was intended.”

On Tuesday night, the Colorado Supreme Court decided that Trump will not appear on the Republican primary ballot in the state, stating that he must be disqualified from holding office under the fourteenth amendment. This decision reversed a lower court ruling that said the fourteenth amendment does not apply to presidents. The Colorado Supreme Court is composed entirely of Democratic appointees and reversed the decision with a 4-3 vote. However, the decision has been stayed until January 4 to allow for review by the U.S. Supreme Court.
